1. Acceptance of Terms

By accessing or using CryptoTaxPilot (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CryptoTaxPilot is a software tool that helps users calculate cryptocurrency capital gains and losses for tax reporting purposes. The Service processes transaction data you provide (via CSV upload or wallet address scanning) and generates tax reports including IRS Form 8949 and Form 8949 CSV files.

3. NOT TAX ADVICE — Important Disclaimer

CryptoTaxPilot is NOT a tax advisor, CPA, accountant, or law firm. The Service is provided for informational and educational purposes only.

  • The tax reports generated by the Service are not a substitute for professional tax advice.
  • We do not guarantee the accuracy, completeness, or correctness of any tax calculations, reports, or recommendations.
  • Cryptocurrency tax law is complex and varies by jurisdiction. You are solely responsible for determining your tax obligations.
  • We strongly recommend consulting a qualified tax professional before filing your tax return.
  • Cost basis methods (FIFO, LIFO, HIFO) may have different implications — consult a tax advisor to determine which is appropriate for your situation.
  • You are solely responsible for the accuracy of your tax filings. CryptoTaxPilot shall not be liable for any errors, omissions, or consequences arising from use of the Service.

4. User Responsibilities

  • You are responsible for providing accurate and complete transaction data.
  • You must review all generated reports before filing and verify their accuracy.
  • You must not use the Service for any illegal purpose, including tax evasion.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.

5. Payment and Refunds

The Service offers a free preview of your tax summary. Downloading tax reports (Form 8949 PDF, Form 8949 CSV) requires a one-time payment of $49 per tax year.

  • Payments are processed securely by Stripe.
  • All sales are final. Due to the digital nature of the product, refunds are generally not provided.
  • If you believe a report contains significant errors due to a software bug (not user data errors), contact us at [email protected] and we will work to resolve the issue or issue a refund at our discretion.

6. Intellectual Property

The Service, including its design, code, features, and content, is owned by CryptoTaxPilot and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or that tax calculations will be accurate or complete.
  • In no event shall CryptoTaxPilot be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or tax penalties.
  • Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless CryptoTaxPilot, its officers, directors, and employees from any claims, damages, or expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your tax filings.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the Service or email.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.
